Changes to Colorado drug crime laws over the past several years have changed the way substance-related offenses are charged and punished. Possession charges involving amounts associated with personal use are now considered misdemeanors. Still, conviction for possession of a Schedule I or II drug could lead to incarceration for as many as 18 months. Moreover, if the authorities believe that there are indications of illegal distribution or manufacturing, you could face felony counts and possibly even federal charges. There are two types of drunk-driving charges under state law: Driving under the influence (DUI) and Driving while ability impaired (DWAI). A motorist whose blood-alcohol concentration (BAC) is .08 percent or higher faces prosecution for DUI.  If your BAC is between .05 and .08, you can be charged with DWAI. In all DUI/DWAI cases, I review the facts thoroughly and fight back if the allegations are based on overzealous police behavior or a problematic test.
