Colorado theft laws and penalties

Under Colorado law, theft occurs when one person intentionally acts to deprive another person of property that belongs to them. The elements the prosecution must prove include:

  • Intent — The accused must intend to steal. Absentmindedly walking off with something does not constitute theft. Even “borrowing without permission” is not theft if the accused meant to return the item.
  • Knowingly taking, holding onto, or controlling — The accused must exercise some type of control over the item and be aware that they are doing so.
  • Acting without authorization or by threat or deception — You cannot steal something you are permitted to have.

Theft crimes and penalties depend on the value of property:

  • Class 1 petty offense — Property valued at less than $50 is punishable by up to 6 months in jail and up to $500 in fines.
  • Class 3 misdemeanor — Property valued between $50 and $300 is punishable by up to 6 months in jail and up to $750 in fines.
  • Class 2 misdemeanor — Property valued between $300 and $750 is punishable by up to 1 year in prison and up to $1,000 in fines.
  • Class 1 misdemeanor — Property valued between $750 and $2,000 is punishable by up to 1.5 years in prison and up to $5,000 in fines.
  • Class 6 felony — Property valued between $2,000 and $5,000 is punishable by up to 1.5 years in prison and up to $100,000 in fines.
  • Class 5 felony — Property valued between $5,000 and $20,000 is punishable by up to 3 years in prison and up to $100,000 in fines.
  • Class 4 felony — Property valued between $20,000 and $100,000 is punishable by up to 6 years in prison and up to $500,000 in fines.
  • Class 3 felony — Property valued between $100,000 and $1 million is punishable by up to 12 years in prison and up to $750,000 in fines.
  • Class 2 felony — Property valued at more than $1 million is punishable by up to 24 years in prison and up to $1 million in fines.

Charges and penalties are more severe when force and/or weapons are used to accomplish the theft.

Colorado burglary law and penalties

Burglary occurs when someone unlawfully enters or remains inside a premises with the intent to commit a separate crime, such as theft or assault. These offenses vary in severity depending on several factors, such as whether:

  • The site broken into was a dwelling
  • The site broken into was a location where controlled substances are kept
  • The perpetrator assaulted or menaced anyone
  • The perpetrator was armed, used a weapon, or threatened to use a weapon
  • The perpetrator used violence

First-degree burglary can be charged as a second-degree penalty with a possible sentence of eight to 24 years in prison and/or a fine of at least $5,000. With stakes so high, it is critical to retain a capable and determined criminal defense attorney.
