At the same time, Colorado has unique laws to govern the use of its valuable resources. The Prior Appropriation System determines who can assess and utilize water from streams and underground sources. Colorado’s Protect Public Welfare Oil and Gas Operations law gives local governments considerable regulatory authority over companies within the oil and gas industry, with power to choose where production facilities may be located, how land may be used and how much noise a facility may produce. Counties and municipalities can also make their own rules for inspecting oil and gas facilities and for imposing fines and fees. Local governments are not hesitant to use their powers. For example, multiple municipalities throughout the state have voted to ban fracking.
